3M Thinks Army Earplug Lawsuits Against Them May Be Thrown Out of Court Before They Begin

Army Earplug Lawsuit News

The company claims that they complied with the design specifications that the military gave them

Monday, April 6, 2020 - Minnesota Mining and Manufacturing (3M) is confident that lawsuits against them claiming the earplugs they sold to the military were defective and caused hearing damage will be thrown out of court. The company asserts, according to a Reuter's report that the company complied with the precision design requirements provided to them by the military and that the military took responsibility for training servicemembers how to use the hearing protection device. More than 2000 veterans have filed suit accusing 3M of knowingly selling defective earplugs to the military that allegedly caused tens of thousands of soldiers hearing damage and tinnitus, a charge that 3M denies and according to the company looks forward to defending themselves in court. Another 3M company spokesperson defended the company's policy to a local news source. The Star Tribune wrote that a 3M spokesperson told them, "Dual-Ended Combat Arms Earplugs Version 2" product and its design reflected the direction and feedback of individuals acting on the military's behalf. We deny this product was defectively designed and caused injuries, and we will vigorously defend ourselves against such allegations." According to the Tribune lawsuits that have been filed will present internal company memos from Aearo Inc., the earplugs manufacturer, and now a 3M subsidiary as knowing that the earplugs design was faulty. "The company knew the earplugs could slip and might not have been long enough to fully protect wearers from loud noises." 3M Dual-sided Combat Army Earplugs have two ends, one long, thinner end to be inserted for loud noises, and the other end, when flipped around was shorter and thicker to allow lower decibel noises like critical battlefield communications to be heard. At the very least the earplugs design was impractical as improvised explosive devices detonated by surprise accounted for a great deal of hearing loss in the wars in the Persian Gulf and Afghanistan and soldiers had no time to make the switch. 3M Army Earplug lawyer offer a no obligation and free consultation to Americans affected from hearing loss due to the faulty 3M Army earplugs.

3M has also pointed out that soldiers thought that wearing and switching back and forth between sides was impractical. Soldiers in combat were resigned to the fact that hearing damage was part of being in the military. Whether onboard an aircraft carrier flight deck, flying in a helicopter, on the rifle practice range, or performing any number of routine military non-combat activities and training soldiers had the choice of whether or not to wear hearing protection. I wrote last week that "soldiers told the General Accounting Office (GAO) that they expected to lose some of their hearing and that it was par for the course for serving their country."

Thousands of soldiers have filed claims for monetary damages alleging that the 3M Dual Sided Combat Army Earplug did not fit properly and caused their hearing loss and tinnitus. 3M may have failed to strictly comply with design specifications and overstated the effectiveness of the hearing protection device. Lawsuits allege that 3M profited by taking advantage of America's wartime needs while failing to deliver as advertised. A whistleblower lawsuit brought by ex-Aearo employees revealed the internal memos showing the company knew in advance that their earplugs were ineffective and exposed 3M's negligence for inadequately testing the product before representing it to the US military.
