Soldiers Thought Their Hearing Protection Was Adequate

Army Earplug Lawsuit News

Most soldiers never questioned whether or not the 3M Combat Earplugs would work and assumed what 3M told them was true

Monday, September 28, 2020 - A recent article in CBS News interview two soldiers with hearing loss who claimed that tinnitus, the constant ringing in the ears, they suffered from was tantamount to torture. Soldiers interviewed were upset because thousands of fighters automatically relied on the representation of the earplugs being 100% effective and that the Army was providing the best hearing protection available sparing no cost. Soldiers believed the devices would work as advertised and never gave a thought to what would happen if they did not. Combat fighters were also more preoccupied with protecting each other's lives and not becoming maimed than they were with losing their hearing. Before the wars, most soldiers assumed that losing some hearing was a necessary evil of serving in the military until they were guaranteed that the Army had the solution.

Hundreds of soldiers are alleging that 3M, the maker of the defective 3M Dual-Sided Combat Army Earplug, knew that the hearing protection device would not work properly because of dangerous design defects and failed to inform the military. The Army Earplug's literal shortcomings were brought to 3M's attention by Aearo Inc., the earplugs original manufacturer. A company whistleblower explained that the earplug would be too short to fit in some soldier's ear canal forcing the company to modify the flanges. These modifications required soldiers to stop what they were doing and remove the earplugs, make adjustments to them, and reinsert them. This maneuver was impractical in the heat of combat. Soldiers were not instructed on how to use the new earplugs. These brave soldiers with permanent, life-altering hearing impairment have joined litigation around the country to seek substantial lump sum compensation to supplement their military disability income.

Military veterans returning home from the war in Iraq and Afghanistan with hearing damage and have filed for disability compensation benefits in record numbers. According to the Veterans Administration (VA) hearing loss is the leading reason for becoming disabled in combat. Military Benefits.Info tell readers "According to the Department of Veterans Affairs official site, hearing damage affects nearly 30 million people in America and is the most prevalent service-connected disability among American Veterans." Soldiers are filing lawsuits against the manufacturer of their standard-issued hearing protection device for additional lump-sum compensation.
