Thursday, September 24, 2020 - Consumer Notice.org provides its readers with up to date consumer product safety information, often warning people and preventing injuries when greedy manufacturers fail to do so. The publication recently reviewed the 3M Dual-Sided Combat Army Earplug manufactured by 3M. 3M is the manufacturer of iconic consumer products such as Scotch Tape, and Post-It Sticky Notes, but the company has branched out in many directions. One of those directions was the $1.2 billion purchase of Aearo Technologies Inc, a maker of hearing protection products and other safety products in 2008. 3M makes a full line of safety, security, and protection products, such as respiratory masks, according to Reuters generating over $3 billion in annual sales. 3M hoped to leverage Aearo's safety product line using its influence as a long-trusted government contactor and 3M intended to sell the 3M Dual-Sided Combat Army Earplugs to the US military. "Aearo, based in Indianapolis, Indiana, makes hearing-protection devices, communication headsets, safety goggles, face shields, reusable and disposable respirators, fall-protection equipment and hard hats, " according to Reuters. At the time of the Aearo acquisition, earplugs and hearing safety equipment made up more than half of their sales.
Problems with the Army Earplug started to materialize when a high percentage of soldiers reported hearing damage occurring during battles in Afghanistan and Iraq, conflicts noted for the enemy's use of eardrum-shattering weapons, not anticipated by the military initially, and the entire fleet of troop transporting vehicles had to be reequipped with reinforcement to safely absorb the blasts. These sudden, unexpected attacks caught units of 20 or more soldiers off guard, causing mangled limbs, blindness, and damaging the hearing of thousands of US soldiers.
The 3M Dual-Sided Combat Army Earplug was standard-issue Army safety equipment but was unable to protect soldiers as the company advertised to the military. Not only did the one-size-fits-all design not fit the varied ear canal sizes of soldiers, but soldiers also were unable or unwilling to stop and switch out the earplugs from allowing low-decibel noises to the other that attempted to block out loud sounds. As a result of the product's failure to protect our soldiers, the US taxpayers have been left to foot the bill for billions of dollars in veteran's disability payments. According to Consumer.org, "More than 1.16 million veterans received disability compensation for hearing loss in 2017, and about 1.79 million veterans received compensation for tinnitus."
Thousands of soldiers returned home from the Afghanistan and Persian Gulf wars with severe, irreversible hearing damage and have sought the counsel of an Army Earplug lawyer to file a claim against 3M for allegedly fraudulently overstating the abilities of the hearing safety device. A record number of soldiers have filed for hearing loss-related disability payments because their hearing injuries have left them unable to readjust to civilian life, hold a job, or engage in family and other relationships. 3M is being held responsible for their negligence, and trials are to begin early in 2021.
