3M Earplug design defects may have caused them to malfunction when soldiers needed them the most

Friday, January 8, 2021 - According to one military veteran, a non-commissioned officer returning home from the Afghanistan war with severe hearing damage, soldiers like him thought they could trust the standard-issue, dual-sided 3M Army Earplug. Soldiers received special training for inserting and using the earplugs. Army earplugs were designed for complex situations, increasing a soldier's confidence in the hearing protection device. Soldiers thought the earplugs labeling implied that they had been tested and that the government had spent money developing the product. 3M Army Earplugs were thought to be strong enough to block out the loudest and most sudden noises while being sensitive enough to allow a soldier to hear critical voice communications. It is alleged that defects in the design, the length of the earplugs specifically, caused them to malfunction when soldiers needed them the most. Officers leading their troops may be experiencing guilt for soldier's combat hearing damage and are angry they trusted 3M.

3M and Aearo Technology, the original developer of the hearing protection device, are accused by hundreds of thousands of soldiers of knowing of the design defect of the earplugs and willfully keeping the facts from the government, the military, and soldiers. Military veterans returning from Afghanistan and Iraq have filed more hearing loss disability claims than any other combat-related injury, according to the Veteran's Administration (VA). Over 200,000 army veterans are suing 3M in what has developed into the largest mass-tort action in US history, surpassing asbestos and tobacco. Federal cases filed independently throughout the country have been organized into Multidistrict Litigation (MDL). Cases were delayed in 2020 due to Covid-19. Pre-trial administrative proceedings have been moving along nicely and are taking depositions from plaintiff expert witnesses and securing medical records. Expert witnesses against the company may include Aearo Technology executives turned whistleblowers that contacted the Department of Justice and filed suit against Aearo/3M under the Fair Trade Act. 3M executives are accused of covering up their knowledge of the design defects of the hearing protection device. 3M purchased Aearo Technology in 2008 to leverage their existing military contract connections and paid the Department of Justice $9.1 million to settle the whistleblower lawsuit.

The majority of the plaintiffs against 3M are young men and women, many of whom had young families, who served the US with honor and were lied to regarding the level of hearing protection the 3M earplugs provided. Military veterans with hearing loss and tinnitus are finding it impossible to assimilate back into civilian life and can not enjoy the lifestyle they desire because their hearing impairment prevents acting as a husband, father, wife, or mother. It is suspected that soldiers suffering from the maddening ringing in the ears called tinnitus may account for many of the suicide deaths that have plagued military personnel once they returned home.
