Thursday, July 11, 2019 - Military veterans who relied on the 3M Army Earplug for hearing protection while in combat are reporting that it took more than a decade for them to realize that they experienced hearing damage from gunfire, noisy military equipment, and explosions. One Army veteran realized in 2019 that his combat service in Iraq from 2002-2004 caused his hearing loss and recently filed suit against 3M for selling their defective Army Earplugs to the military. The soldier in question suffers from Tinnitus, a constant high-pitched ringing in the ears that renders sufferers unable to sleep or concentrate according to Court House News.com. While 3M did not originally manufacture the earplugs mentioned in the lawsuit, the company did acquire their maker, Aearo Technologies in 2008. Aearo allegedly knew that the earplugs were too short and narrow to completely block out noises. Court House News reports: "Aearo also lied about the earplugs noise reduction rating and did not tell the military that for the earplugs to work properly, flanges on them had to be folded back so they could be placed more deeply into the ear, according to the lawsuit." As a result of a whistleblower lawsuit, 3M has had their contract to supply the military with earplugs revoked and the company has discontinued making the device. 3M agreed to reimburse taxpayers $9.1 million dollars for their negligence as a result of a company whistleblower coming forward with what they knew about the device's shortcomings. Under the Whistleblower's Act, 25% or around $2million of the $9 million goes to the whistleblower for their efforts in saving taxpayer's money and in this instance, saving soldiers lives. Over one thousand US service members have filed complaints seeking compensation against 3M for fraudulently representing the Army Earplug and causing hearing loss that ranges from mild to profound. Soldiers suffer from Tinnitus more than any other hearing-related injury. Tinnitus is a maddening, non-stop, high-pitched ringing in the ears that prevents the victim from experiencing a moment of peace. Tinnitus sufferers often leave a fan on and a TV playing when trying to sleep to compete with the ringing. Tinnitus also cause headaches and dizziness that can prevent service members from ever returning to the workforce. The Veteran's Administration reports that hearing loss is the most common injury reported by veterans of foreign wars.
Health Hearing.com tells us that Noise-Induced hearing loss can be caused in a mere instant and is not necessarily due to prolonged exposure to high decibel levels. "(NIHL) can be caused by exposure to a one-time loud noise, such as an explosion, or to sounds louder than 85 decibels (dB) over an extended period of time. ... Head or acoustic trauma: Damage to your inner ear can also be caused by a blow to the head or exposure to an extremely loud noise, such as an explosion."
All active-duty service members are encouraged to seek hearing examination conducted by an independent audiologist in order to officially register the extent of their hearing loss and then to contact an Army Earplug attorney in order to file a claim against 3M.
