3M falsified test results that the military required of contractors that wanted to compete for the Army's business

Friday, October 11, 2019 - Over one thousand US Army veterans have filed suit against 3M Corporation to be compensated for the damages they have incurred from the hearing damage the 3M Combat Army Earplug caused them. To summarize, 3M sold millions of pairs of defective army "hearing protection" devices to the US government as part of a multi-billion dollar defense contract that 3M was awarded. 3M certified to the military that the earplug was of the unique design to block loud explosive sounds from improvised explosive devices (IEDs), gunfire, and others while simultaneously allowing lower-volume verbal communication to be heard. In reality, however, the earplug's faulty design allowed the explosive sounds to enter the ear canal and damage a soldier's hearing causing hearing loss and tinnitus. Countless soldiers have died in combat after having been rendered instantly deaf from IED explosions, unable to communicate or engage in the combat situation in which they were immersed. 3M settled a whistleblower lawsuit from a competitor in 2015 for a $9.1 million, a fraction of the billions that the company earns from the military contracts every year, however, 3M never issued a recall of the defective device. According to NationofChange.org, a US Army veteran has filed suit against 3M and Aero and accused both companies of deliberately tampered with testing that exposed the design defect of the 3M Combat Army Earplug and presented falsified information to the US government. A lawsuit filed by a Kevin Doyle, a former U.S. Marine, "3M and its Aearo Technologies LLC subsidiary falsified test results in order to sell defective earplugs to the military for a multi-million dollar per-year contract. Although 3M discontinued selling the defective earplugs in 2015 due to a design defect, the company never issued a recall for them." Doyle served as a weapons instructor from '03 to '10 and developed tinnitus and hearing loss. In an interesting bit of legal investigation, Doyle's attorney claims that a company is required to give a representation of the specific benefits that the piece of protective equipment offers the military before it is accepted to be bid on. It is at that time that 3M certified that their Combat Army Earplug would effectively protect a soldier's hearing during combat or wherever loud noises would occur. Nation of Change reports "Doyle's lawsuit alleges that both 3M and Aearo knew the earplugs were defective and falsified test results in order to acquire the multi-million dollar per-year military contract. Because the defect was imperceptible to the wearer, the design flaw went undetected for more than a decade by the U.S. military and those who wore the earplugs."

Doyle's lawsuit seeks monetary damages for lost income, medical expenses and pain, and suffering. Tinnitus is a maddening condition often called "ringing in the ears" and can leave a soldier unable to sleep.
