Soldiers With Hearing Damage Are Blaming Their Earplugs

Lawsuits are being filed in every state that hosts a military base, alleging that soldiers have experience hearing loss from their standard issue 3M Army Earplugs

Wednesday, May 22, 2019 - The lawsuits are very similar to one another in that military personnel that served in Afghanistan and Iraq from 2005 to 2015 have returned home with hearing damage ranging from moderate to extreme. An extreme case of hearing damage would be considered to be tinnitus, where the soldier experiences a constant, maddening ringing in the ears. In 2018, 3M settled a Department of Justice lawsuit against them for $9 million that alleged that 3M knew that the earplugs were defective but hid this information from the military. According to Kansas City.com, "lawsuits allege that 3M sold the trademarked Dual-Ended Combat Arms earplugs to the U.S. military even after it was aware of problems with the product." The concept of "dual purpose" earplugs for the military was born years ago during the era when the United States military transitioned from engaging in jungle warfare to that of urban house to house fighting and from tropical to desert climates. Urban warfare requires a much higher level of coordination amongst troops as they traverse streets in small groups of 10 -12 soldiers, traveling about 50 meters from one another. Soldiers in Iraq were tasked with going from house to house on streets that were often boobie trapped with improvised explosive devices (IED)s. IEDs not only tore limb from limb but also deafened troops that were riding in vehicles that were attacked. In Iraq, there was a critical need for soldiers to communicate the status of every room they clear yet still have hearing protection from the unexpected rein of gunfire or an explosion. Soldiers fighting were duped into thinking that the dual purpose earplugs would allow for verbal communications as well as block out the occasional and unexpected loud burst of noise. The 3M Army Earplug advertisement reads: "(The earplugs are) designed to allow the wearer to hear low-level sounds when the yellow side is inserted."

In reality, the 3M Army earplug failed soldiers in two ways. One way is that the earplug's one-size-fits-all design prevented them from fitting snugly and allowed loud noise to enter. 3M mislead soldiers by claiming that the earplugs had a "pre-molded triple-edged designed fits most ear canals." according to the product's literature. In reality, the earplugs rarely fit allowing for an unsafe level of outside noise to enter.

The 3M earplug's second level of inadequacy was that in order to allow for blocking explosive noises, the earplugs had to be manually reversed in order to be effective and this required a soldier stopping what he was doing, put down their firearm, take off their helmet, and turn their earplugs around, hardly a practical maneuver during the heat and chaos of battle.

According to the Kansas City Star, one of the hundreds of lawsuits alleges "The Dual-Ended Combat Arms earplugs have likely caused thousands, if not millions, of soldiers to suffer significant hearing loss, tinnitus, and additional injuries related to hearing loss, including but not limited to pain and suffering and loss of the pleasures of life."
