Tuesday, October 27, 2020 - In July of 2018, 3M Inc. settled an Army Earplug whistleblower lawsuit against them for $9 million and drew the attention of the military's fraud prevention unit. The army publication Task and Purpose described the action brought by a former Aearo Technologies whistleblower and the US Department of Justice (DOJ) as stemming from the company's selling earplugs to the military that they knew were defective and could indirectly cause a soldier's death. The Army fraud division called 3M's actions pure greed and blamed 3M Inc. for the epidemic of hearing damage that has plagued veterans returning home from wars in Iraq, Afghanistan, and elsewhere. 3M purchased Aearo Tech in 2007 for $1.2 billion hoping to leverage its military defense contracts with Aearo's hearing protection technology. The Army Fraud division responded to 3M's settlement, firmly warning other companies that the military would scrutinize each defense contract in the future. "Today's settlement will ensure that those who do business with the government know that their actions will not go unnoticed," Frank Robey, the head of the Major Procurement Fraud Unit at the Army's Criminal Investigative Command, said in a statement. "Properly made safety equipment, for use by our Soldiers, is vital to our military's readiness. Our agents will respond robustly to protect the safety of our military," according to T and P. The DOJ said in a statement that the earplugs were useless because they were simply too short to fill the ear canal allowing loud noise to enter. "dual-ended Combat Arms Earplugs, Version 2 (CAEv2) to the Department of Defense, despite allegedly knowing that the plugs were "too short for proper insertion into users ears and that the earplugs could loosen imperceptibly," according to the DoJ statement. "According to reports from the U.S. Judicial Panel on Multidistrict Legislation, including the most recent Oct. 15 MDL Statistics Report, the IN RE: 3M Combat Arms Earplug Liability Litigation MDL has amassed 203,722 total actions since its 2018 inception," according to Bloomberg Law.
